This End User License Agreement (this “Agreement”) is a legal agreement between (i) you (either as an individual, or a single legal or contractual entity), and (ii) Monsanto Canada Inc. and its Affiliates (including The Climate Corporation) (“we”, “us” or “Monsanto”). By downloading, installing, activating or otherwise using the Climate Products, you represent and warrant (a) that you are at least 18 years of age or the age of majority where you reside, (b) that you are acting for business purposes, and (c) that you have the power and authority to enter into this Agreement; and, you agree to be bound by these terms and conditions, including The Climate Corporation’s Privacy Policy. If you are entering into this Agreement on behalf of a company or other legal or contractual entity, you represent that you can bind such entity, in which case “you” or “your” shall refer to such entity.
