PUBLIC RIGHT-OF-WAY USE AGREEMENT This PUBLIC RIGHT-OF-WAY USE AGREEMENT ("Agreement") is hereby made and entered into by and between the CITY OF FORT WORTH, a home rule municipal corporation organized under the laws of the State of Texas and acting by and through Richard Zavala, its duly authorized Acting Assistant City Manager, and HOLLIS R. SULLIVAN, INC., acting by and through Hollis R. Sullivan, President. The following statements are true and correct and constitute the basis upon which the City of Fort Worth has executed this Agreement. A. Hollis R. Sullivan, Inc., a Texas Corporation ("Company") wishes to construct a pipeline for the transportation of natural gas under certain Public Rights-of-Way. Because Company is not a public utility, as that term is used in the City Charter and City Code, as well as generally under applicable state laws
