This Data Protection Terms addendum ("Addendum") forms part of the agreement based on the EmailOctopus Terms of Use (“Agreement”) between Three Hearts Digital Ltd (“EmailOctopus”); and the person or entity identified as ‘you’ or ‘the Customer’ under the Agreement, to whom EmailOctopus provides services under the Agreement (the "Customer”). This Addendum applies where and only to the extent that EmailOctopus processes personal data as defined under the UK General Data Protection Regulation (UK GDPR) as supplemented by Data Protection Act 2018 (DPA 2018) that originates from the UK or the EEA (and/or that is otherwise subject to Data Protection Legislation) on behalf of the Customer as data processor in the course of providing the EmailOctopus service under the Agreement. Data Protection Legislation means the UK General Data Protection Regulation (UK GDPR) as supplemented by Data Protection Act 2018 (DPA 2018).
