This Agreement is entered into by and between SlashNext, Inc., a Delaware corporation with an address at 6701 Koll Center Parkway Suite 250, Pleasanton CA 94566 (“SlashNext”), and the Customer. The “Effective Date” of this Agreement is the date which is the earlier of (a) Customer’s initial access to any Service or Software (as defined below) through any online provisioning, registration or order process or (b) the effective date of the first Order Form or Resale Arrangement, as applicable and as defined below, referencing this Agreement. This Agreement consists of the terms and conditions set forth below and any attachments, addenda or exhibits referenced in the Agreement, and any Order Forms that reference this Agreement.
