WHEREAS, effective October 19, 1965, the Electrical Contractors Association (the “Association”) and Local Union 134 I.B.E.W. (the “Union”) entered into an agreement and declaration of trust (the “Trust Agreement”) to establish a pension fund to provide retirement, disability and death benefits to members of the Union and other plan participants employed by members of the Association and other employers in the construction industry within the geographic jurisdiction of the Union in accordance with the provisions of collective bargaining agreements between the Association and the Union; and
