This Software License Agreement (this “Agreement”), is effective as of the day Licensee agrees to these terms and conditions by installing the Software (the “Effective Date”), by and between iPayment, LLC, an Indiana limited liability company (“Licensor”), and you, as the installer and user of the Software (“Licensee”). Licensor and Licensee may be referred to herein collectively as the “Parties” or individually as a “Party.” In the event of an inconsistency between this Agreement and any terms or conditions related to the Software that have been presented to you, the terms and conditions of this Agreement shall control.
