In 2009, the European Union (EU) adopted Directive 2009/125/EC1 establishing a framework for the setting of ecodesign requirements for energy-related Products (“ErP”) to create a framework for the development of EU-wide rules for improving the environmental performance of energy-related Products through eco-design minimum requirements. The Directive is referred to below as the “Ecodesign Directive”. At the same time, the Commission recognised the possibility of having a Voluntary Agreement provided that the industry sector in question fulfilled the conditions included in the mentioned Directive.
