Pursuant to the terms and conditions of the 1996 biological opinion, RAs must include SSPMs in the SMCRA permit. If the RA does not incorporate the SSPMs as provided by the Service into the permit or if the SSPMs are not implemented appropriately, the permit may not be in compliance with the term and conditions of the 1996 biological opinion.
