This MF Global Plan Trust Agreement (this “Trust Agreement”), dated and effective as of June 4, 2013 (the “Effective Date”), by and among MF Global Holdings Ltd. (“Holdings Ltd.”) and the following parties (each, together with any successor thereto, a “Trustee” and collectively, the “Trustees”), (1) Joe Kronsberg, not in his individual or personal capacity, but solely in his capacity as the designee of Creditor Co-Proponent Cyrus Capital Partners, (2) Daniel Ehrmann, and
