Contract Type FiledSeptember 10th, 2024WHEREAS, as of September , 2024 (the “Effective Date”), VILLAGE AT GATEWAY PARTNERS, LP, a Texas limited partnership, hereinafter referred to as (“Developer”), has received final plat approval from the City of Forney (“City”) for an approximate 66.3968 acres of land out of the Samuel Smith Survey, Abstract No. 450 within the City of Forney, Texas, or its extraterritorial jurisdiction, as further described on the attached “Exhibit A” (the “Development”), said final plat being further described as Final Plat Lot 2, Block 2, and Lots 1-6, 7A-7D, 8-15, Block 3 Village at Gateway, an addition to the City of Forney, Kaufman County, Texas (the “Plat”); and
