This Appy Health, Inc. SaaS Services Agreement (“Agreement”) is entered into on June 14, 2021 (the “Effective Date”) between Appy Health, Inc. with a place of business at 6860 Dallas Parkway, Suite 200, Plano, TX 75024 (“Company”), and the customer (“Customer”). This Agreement includes and incorporates all Exhibits, as well as the attached Terms and Conditions and contains, among other things, warranty disclaimers, liability limitations and use limitations found at www.appyhealth.com. In addition, Customer will be subject to any additional terms applicable to such Service found in the Business Associate Agreement which is attached hereto and incorporated by reference into this Agreement. In the event of a conflict between the terms of this Agreement and all other agreements and policies incorporated herein by reference, the terms of this Agreement will control.
