This Data Processing Addendum (“Addendum”) is effective as of the date it is completed and signed by Subscriber, and forms part of the Subscription Agreement (“Subscription Agreement”) between the applicable iCIMS contracting entity under the Subscription Agreement (“iCIMS”) and the entity that executed the Subscription Agreement and/or Order Form (“Subscriber”) acting on its own behalf and as agent for each Subscriber Affiliate. For the avoidance of doubt, if the entity signing this Addendum is not a party to a Subscription Agreement with iCIMS or an iCIMS Affiliate that is currently in effect or this Addendum is not being signed concurrently therewith, this Addendum is not valid and not legally binding.

This SkillSurvey Data Processing Addendum (“Addendum”) is incorporated into and forms part of the Subscription Agreement, SkillSurvey Terms and Conditions, SkillSurvey Addendum, and/or other applicable terms or agreement (“Subscription Agreement”) between the applicable iCIMS contracting entity under the Subscription Agreement (“iCIMS”) and the entity that executed the Subscription Agreement and/or Order Form (“Subscriber”) acting on its own behalf and as agent for each Subscriber Affiliate.
