NOW THEREFORE, in consideration of the covenants, agreements and releases set forth herein and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, it is agreed by the Parties that the BC Action and Ontario Action be settled and dismissed with prejudice as to the Settling Defendants only, and the Quebec Action be declared settled out of court with prejudice against the Settling Defendants, all without costs as to the Plaintiffs, the classes they seek to represent, or the Settling Defendants, subject to the approval of the Courts, on the following terms and conditions:
