Contract Type FiledApril 24th, 2019The Education Code Section 38130 et seq., also known as the Civic Center Act1, states that “[e]very public school facility is … a civic center.” Accordingly, districts are frequently requested by businesses, public entities, and members of the public to provide access for use of their facilities. Such use could pose a significant premises liability exposure (in addition to wear and tear) to the district’s facilities if the use is not controlled and strictly risk managed. The goal of these guidelines is to balance the mandate for the use of school facilities as a civic center with the need to manage appropriate and safe use of school facilities while maintaining minimal liability impact to the district.
