between THE ILLINOIS STATE TOLL HIGHWAY AUTHORITY, an instrumentality and administrative agency of the State of Illinois, hereinafter called the "ILLINOIS TOLLWAY", and the COUNTY OF KANE, a body corporate and politic of the State of Illinois, hereinafter called the “COUNTY”. The ILLINOIS TOLLWAY and the COUNTY are each hereinafter sometimes individually referred to as “PARTY”, and are collectively referred to as “PARTIES”.
