This Energy Efficiency Loan Program Agreement (the “Agreement”), dated as shown on the signature pages to this Agreement (the “Effective Date”), is undertaken by the City of Fort Collins, a municipal corporation and political subdivision duly organized and existing as a home rule city under Article XX of the Constitution of the State of Colorado (“Fort Collins” or the “City”), and Elevations Credit Union, a Credit Union chartered under the laws of the state of Colorado, (the “Lender” or “Elevations”) (each a “Party” and collectively the “Parties”).
