IT IS HEREBY STIPULATED by and between Plaintiff Angelina Vasquez, on behalf of herself and others similarly situated, on the one hand, and Defendants CP Retail, LLC (“CP Retail”) and Winmark Corporation (“Winmark Corporation”) on the other hand, and subject to the approval of the Court, that the Lawsuit is hereby being compromised and settled pursuant to the terms and conditions set forth in this Stipulation of Class and Representative Action Settlement (“Settlement Agreement”) and that the Court shall make and enter judgment, subject to the continuing jurisdiction of the Court as set forth below, subject to the definitions, recitals and terms set forth herein which by reference become an integral part of this Settlement Agreement.
