WHEREAS, plaintiffs and defendant Lisa P. Jackson, the Administrator of the United States Environmental Protection Agency (“EPA”), have advised the Court that, on November 22, 2010, they executed a settlement agreement (the “Agreement”), attached hereto as Exhibit A, to resolve their disputes in this action.
