A MERCHANT’S SUBMISSION OF A TRANSACTION TO SERVICERS SHALL CONSTITUTE RATIFICATION OF EACH AND ALL OF MERCHANT’S OBLIGATIONS UNDER THIS AGREEMENT. To the extent Merchant accepts American Express (“AXP”) cards, the provisions in this Agreement with respect to AXP apply if Merchant does not have a separate agreement with AXP.
