THIS AGREEMENT (“Agreement”) is entered into by and between THE CENTERS FOR MEDICARE & MEDICAID SERVICES (“CMS”), as the Party (as defined below) responsible for the management and oversight of the Federally-facilitated Exchanges (“FFEs”), and [insert name and designation number of organization], an organization that has been designated by CMS as a Certified Application Counselor Designated Organization (hereinafter referred to as “CDO”) in [insert name of applicable FFE state(s) in which organization is designated], a State/States in which an FFE is operating. CMS and CDO are hereinafter sometimes referred to as “Party” or, collectively, as the “Parties.”
