This Terms and Conditions agreement sets forth terms and conditions relating to the provision and use of SurgeMetrix’s products and services ordered through the Online Order Form (Order Form) and any addendum thereto. The Order Form, any addendum thereto, any Statement of Work associated therewith and this Terms and Conditions document collectively constitute the "Agreement". Any capitalized terms that are not defined in these Terms and Conditions shall have the meanings given those terms under the Order Form. Without limiting the foregoing, "SurgeMetrix" means collectively New Perspective Apps LLC (DBA “SurgeMetrix”), and its applicable affiliates that provide the SurgeMetrix products and services. The Client, as identified in from the SurgeMetrix Online Order Form (see https://surgemetrix.com/so-order-dealer/), represents that it has read these Terms and Conditions and agrees to be bound by them.
