This Agreement shall take precedence over any terms and conditions which appear in Customer’s Order or in any documents incorporated by reference in Customer’s order. No term or condition in addition to or different from the terms and conditions contained herein shall become part of any such contract unless explicitly referenced and agreed to in writing by Rapid’s authorized officer or representative at our principal office in Lexington, Massachusetts. Rapid’s failure to object to any provision contained in any communication from Customer shall not be construed as a waiver of these terms and conditions nor as an acceptance of any such provision.
