A Florida prenuptial agreement is a contract entered into by two (2) parties prior to marriage to spell out the division of assets and property upon divorce, and the management of said assets and property throughout the marriage. Without a prenup, the state’s laws in which the couple reside will determine who owns what following the divorce or death of a spouse. Both parties are advised to discuss their current financial system frankly, clearly defining their assets and liabilities prior to entering into the agreement. Signing requirements (§ 61.079 (3)) – Only the signatures of both spouses are required. A notary acknowledgment is recommended. 61.079 – Premarital agreements.
