This Equipment Agreement {"Agreement") is entered into between the undersigned client {"Client") and Bank of America, N.A. ("Bank"); is entered into in connection with the agreement for merchant services by and among Client and Bank or any of its predecessors, as applicable (as amended, including all addenda and supplements thereto, the "Merchant Agreement"); and takes effect as of the date indicated on the signature page to this Agreement. For purposes of this Agreement: (a) the words "we", "our", and "us" refer on!y to Bank; (b) the words "you" and "your" refer to Client; (c} "Person" means any individual or entity other than Bank or Client; (d) "Affiliate" means a Person that, directly or indirectly, owns or controls a party to this Agreement or is under common ownership or control with a party to this Agreement; and {e) "Equipment" means any Purchased Equipment and any Rental Equipment identified in Section 2 or Section 3 of this Agreement.
