This Safe Harbor Agreement (“Agreement”) is made and entered into by and among Trustees of the Estate of Bernice P. Bishop, dba Kamehameha Schools (“Permittee” or “KS”); the U.S. Department of the Interior, Fish and Wildlife Service (“Service”); and the State of Hawaiʻi, Department of Land and Natural Resources (“DLNR”), by its Board of Land and Natural Resources; hereinafter collectively called the “Parties”. This Agreement follows the Service’s Safe Harbor Agreement final policy (FR 64:32717) and applicable final regulations (FR 64:32706), and implements the intent of the Parties to follow the procedural and substantive requirements of section 10(a)(1)(A) of the Endangered Species Act (“ESA”) and Hawaiʻi Revised Statutes (“HRS”) §195D-22.
