The Sun Prairie Area School District (District) enters into the following Agreement to resolve compliance review #05-11-5003. The review addressed whether African American students are subjected to discrimination on the bases of race and/or disability, in the pre-referral/referral and evaluation of these students for special education and their placement in special education. The District enters into this Agreement to ensure its compliance with Title VI of the Civil Rights Act of 1964 (Title VI), 42 U.S.C. § 2000d, and its implementing regulation, 34 C.F.R. Part 100, which prohibit discrimination on the basis of race, color or national origin, Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794 (Section 504), and its implementing regulation at 34 C.F.R. Part 104, which prohibit discrimination on the basis of disability in programs, services or activities operated by recipients of Federal financial assistance, and Title II of the Americans with Disabilities Act of 1990, 42 U.
