EXHIBIT ADeveloper's Agreement • September 18th, 2015
THIS DEVELOPER'S AGREEMENT (this "Developer's Agreement" or this "Agreement") is entered into by and between JARONE DEVELOPMENT, LLC, an Ohio limited liability company, hereinafter referred to as "Developer", and the CITY OF AVON, Lorain County, Ohio, hereinafter referred to as "City". "Council" shall refer to the City Council of Avon, Lorain County, Ohio, and "City Engineer" shall refer to the City Engineer of the City of Avon or his designee hired to perform services on this project. The term "Development" shall refer to the reconstruction of Nagel Road from the I-90 interchange to a point approximately 600 feet south of the new Middleton Road. The project shall include the installation of left turn lanes along Nagel Road north and south of Middleton, pavement markings, traffic signalization, storm sewer, curb and gutter, and all appurtenances thereto, (collectively, referred to as the "Public Improvements").
