This HIPAA Business Associate Addendum (this “BAA”) is part of the Enterprise Contract for AWS Marketplace (the “Enterprise Contract”) or the Standard Contract for AWS Marketplace (the “Standard Contract”), as applicable, between a Buyer and a Seller (for Enterprise Contracts) or a Licensor (for Standard Contracts) and governs the creation, receipt, maintenance, or transmission of Protected Health Information on Buyer’s behalf. Each of the Standard Contract and the Enterprise Contract is a Marketplace Contract. Each Seller and each Licensor is a Supplier. This Addendum is not applicable if Supplier does not create, receive, maintain, or transmit Protected Health Information on behalf of Buyer or if Buyer is not subject to the Administrative Simplification of the Health Insurance Portability and Accountability Act of 1996, as amended, and its implementing regulations (collectively “HIPAA”) as a Covered Entity or Business Associate.
