THIS GUARANTY dated as of January 12, 2009 (this "Guaranty") is made by Kingston Properties L.P. (the "Guarantor"). Capitalized terms used but not defined herein have the meanings assigned to them in the Participation and Servicing Agreement dated as of January 12, 2009 (the "Participation Agreement") by and between ANB Venture, LLC, a Delaware limited liability company (the "Company") and the Federal Deposit Insurance Corporation ("FDIC") as Receiver for ANB Financial, N.A. ("Participant").
