The depositor purchased and does hereby deliver to Bank a certificate of deposit issued by Bank in the amount mentioned above as the certificate of deposit amount. The Depositor hereby assigns and transfers to the Kansas Department of Health and Environment, Bureau of Waste Management (hereinafter referred to as "KDHE") all rights, title and interest in the certificate of deposit numbered above in the the amount named above to be held in trust by Bank to secure payment of closure costs by Depositor. The Depositor may not assign, pledge as security for any loan, or otherwise encumber the certificate during the period of this agreement.
