This Joint Stipulation of Settlement and Release (the “Agreement”) is entered into by and between Matthew Sunner (“Named Plaintiff”), individually and on behalf of the class of individuals he seeks to represent (“Class Members”) (together with Named Plaintiff the “Plaintiffs”), Kenneth R. Turnage II (“Turnage”) and Kenneth R. Turnage II General Contractor, Inc., d/b/a K2GC, Inc., a California Corporation, together with its predecessors, successors, affiliates, subsidiaries, parent companies, or any other related entities, and their former and current directors, officers, partners, employees, and agents (“K2GC” or the “Company”) (collectively, “Defendants”) (together with Plaintiffs, the “Parties”).
