In entering this Contract, the Department relies on the representations contained in the “Non Responsible Party Application for Voluntary Cleanup Contract" of February 22, 2022, and any amendments thereto, by Lexington THB Fee Owner, LLC, A North Carolina Limited Liability Company, which is incorporated into this Contract and attached as Appendix A.
