This Patent Cross-License and Settlement Agreement (“Agreement”) is entered into as of the date of the last signature set forth on the signature page below (the “Effective Date”), between Overland Storage, Inc. (“Overland Storage”) on the one hand and BDT Media Automation GmbH and its subsidiaries and affiliates (collectively “BDT”) on the other.
