THIS AMENDMENT NO. 2 is entered into by and between the Texas Facilities Commission (hereinafter referred to as “TFC”), a state agency and Southwest Valley Constructors Co., a Delaware Corporation, (hereinafter referred to as “DB,” or “Design-Build Firm”) (hereinafter collectively referred to as the “Parties”) to amend the Design-Build Agreement (hereinafter referred to as the “Agreement”), as amended.
