Acceptance. These Standard Terms and Conditions and the Sales Order (taken together, the "Agreement") constitute the entire agreement of Violin Systems LLC, and its subsidiaries ("Seller") and the customer identified in the Sales Order ("Buyer") for the purchase and sale of Products and Services. In the case of any conflict or inconsistency between these Standard Terms and Conditions and the Sales Order, the provisions of these Standard Terms and Conditions shall control. This Agreement controls over any additional or different terms in Buyer's acknowledgment, purchase order or other documentation. Buyer's acceptance will be indicated in any reasonable manner (such as, for example, by submitting a purchase order referencing the Sales Order or taking delivery of or paying for any Product or Service).
