This Customer Agreement (this “Agreement”) contains the terms and conditions that govern your access to and use of the Wasabi data storage platform (the “Wasabi Service”) and is an agreement between you (“you” or “your”) and Wasabi Technologies LLC (“Wasabi,” “we,” “us,” or “our”). The acceptance by you of this Agreement, and any referenced policies, including the Wasabi Service Level Agreement and Wasabi Platform Terms of Use and Acceptable Use Policy is required before you can set up a Wasabi account. You may view and download various documents and policies at www.wasabi.com/legal prior to the registration process. Additional product terms are found at https://wasabi.com/product-terms/. In the event of any conflict between the terms and conditions of this Agreement and any exhibit, policy, or product terms, the terms of the applicable exhibit, policy or product terms shall prevail.

This Customer Agreement (this “Agreement”) is effective on January 28, 2020 (“Effective Date”) between Wasabi Technologies, Inc., with offices at 111 Huntington Ave, 29th Floor, Boston, MA 02110 (“Wasabi”, “we”, “us” or “our”) and The Regents of the University of California on behalf of the University of California, Office of the President, with offices at 1111 Franklin Street, Oakland, CA 94607 (“Customer” or “you”). This Agreement contains the terms and conditions that govern Customer’s access to and use of the Wasabi data storage platform (the “Wasabi Service”).
