This Settlement Agreement (this “Agreement”) is entered into as of the of December, 2006 by and among FR Sturtevant Street, LLC, a Delaware limited liability company (“FRS”), FR Assembly Square, LLC, a Delaware limited liability company (“FRA”) (FRS and FRA, together with each of their respective affiliates, successors and assigns, collectively, “FRIT”), IKEA Property, Inc., a Delaware corporation (together with its affiliates, successors and assigns, collectively, “IKEA”), the individuals listed on Schedule 1 attached hereto and incorporated herein (the “MVTF Associates”) and the Mystic View Task Force, Inc. a Massachusetts not-for-profit corporation (together with its successors, assigns, and the MVTF Associates, collectively, “MVTF”) (FRIT, IKEA and MVTF each, individually, a “Party” and, collectively, the “Parties”).
