• A Settlement Agreement, also referred to as the “Settlement,”1 has been reached in a class action lawsuit about whether Hot Topic, Inc. (“Hot Topic”) sent or caused to be sent advertisement or telemarketing text messages to mobile telephone numbers without first obtaining express written consent of the recipients in violation of the Telephone Consumer Protection Act, 47 U.S.C. § 227 (“TCPA”). Hot Topic denies the allegations in the lawsuit and the Court has not decided who is right.
