This Class Action Settlement Agreement (the “Agreement” or “Settlement”) is entered into by and among plaintiff, Jordan Schwyhart (“Plaintiff”), for himself individually and on behalf of the Settlement Class and Damages Settlement Subclass (as defined below), and Defendant, AmSher Collection Services, Inc. (“Amsher” or “Defendant”) (Plaintiff and Defendant are collectively referred to as the “Parties”). This Agreement is intended by the Parties to fully, finally, and forever resolve, discharge, and settle the released claims identified in Section 4 below upon and subject to the terms and conditions hereof, and is subject to the approval of the Court.
