This Agreement is between you and American Express National Bank (“we”, “us”, or “AENB”). It establishes the terms and conditions governing the Service that is provided for eligible Account(s) that you have with us. Other agreements you have entered into with us, including the American Express National Bank Consumer Savings Deposit Account Agreement (“Deposit Account Agreement”) applicable to your American Express National Bank Account(s), are incorporated by reference and made a part of this Agreement. Except in the case of irreconcilable conflict between this Agreement and the Deposit Account Agreement, the Deposit Account Agreement governs and applies to this Agreement and all mobile check deposits you make or attempt to make to your Account pursuant to this Agreement.
