Waiver and Release: As further set forth in the Terms and Conditions of this Fishing Trip Agreement, Client hereby waives any claims which Client may have against Hook’em Up and Fishing Guide and releases Hook’em Up and the Fishing Guide from all liability for injury, death, property damage or any other loss sustained to Client and any member of Client’s Party a result of Client’s participation in the Fishing Trip due to any cause whatsoever including without limitation, negligence on the part of Hook’em Up and the Fishing Guide. Client further agrees to indemnify Hook’em Up and the Fishing Guide for any and all legal fees or costs which may be incurred in defending any lawsuit or claim that Client or any member of Client’s Party may bring against them.
