The Parties contemplate that from time to time the customer identified above (“Customer”), will order equipment, software and/or services from Fujitsu America, Inc. (“Fujitsu”), under Fujitsu order forms or statements of work (each an "Order Form"). To facilitate placement and processing of the orders, the Parties agree that the terms and conditions of this Master Agreement (“Agreement”), including all attachments hereto which are designated below as applicable, shall apply as of the Effective Date specified above to equipment, software and/or services ordered under any Order Form that states it is subject to the terms and conditions of this Agreement and that is signed by the Parties. Neither this Agreement, nor any Order Form, shall be binding on Fujitsu unless accepted in writing by an authorized Fujitsu representative.
