ROAD CONCESSION AND LEASE AGREEMENT (this “Amendment”) is made and entered into, as of this 21st day of September, 2018 (the “Effective Date”), by and between the Indiana Finance Authority, a public body politic and corporate of the State of Indiana (the “IFA”) and ITR Concession Company LLC, a Delaware limited liability company (the “Concessionaire”) (collectively, the “Parties”) and, solely with respect to the payment obligations set forth in Section 7, Concession Investment Holdings, LLC, a Delaware limited liability company.
