This Class Action and PAGA Settlement Agreement (“Agreement”) is made by and between the Named Plaintiffs, John Arias, Jeffrey Hensley, and Esteban Romo, for their own behalf and on behalf of all members of the Settlement Class, as defined below, on the one hand, and Defendant Flowserve US Inc. on its own behalf and on behalf of its past and present parents, subsidiaries and affiliates, and their respective past and present predecessors, successors, assigns, representatives, officers, directors, agents and employees1, on the other hand (collectively the “Parties,”), in the lawsuits Arias and Hensley, et al. v. Flowserve US, Inc., et al, filed in the Los Angeles County Superior Court, Spring Street Case No. 22STCV27829 and Romo, et al. v. Flowserve US, Inc., et al, filed in the Los Angeles County Superior Court, Case No. 22STCV27551. This Settlement Agreement resolves all claims that were asserted or could have been asserted against Defendants pertaining to the claims in the Litigation.
