Donlin, Recano & Company, Inc. (hereinafter called “DRC”) agrees to provide Chieftain Sand, including but not limited to any and all bankruptcy cases filed by any affiliate of Chieftain Sand. (hereinafter called the “Client”) and Client agrees to purchase services upon the terms and conditions and in accordance with “Schedule A”, attached hereto, and other provisions stated herein, including but not limited to services to be rendered by DRC in connection with solicitation, calculation and tabulation of votes under any plan of reorganization or liquidation (the “Voting Services”). Client agrees and understands that none of the services constitute legal advice.
