The terms and conditions of this Data License Agreement (this “Agreement”) constitutes a binding legal contract between Qualcomm Technologies, Inc. (“QTI”) and the person or entity downloading data made available by QTI (“Licensee”). Licensee’s download, installation or use of the Licensed Data (as defined below) constitutes acceptance of this Agreement. If Licensee does not agree to any part of this Agreement, then Licensee may not download or use the Licensed Data and must delete any copies of the Licensed Data in Licensee’s possession or control. If Licensee is downloading, installing or using the Licensed Data (as defined below) on behalf of a legal entity, then the individual accepting the terms of this Agreement on behalf of such legal entity represents and warrants that he/she has the authority to bind that legal entity to the terms of this Agreement, and, in such event, “Licensee” will refer to that legal entity.
