This Merchant Application and Agreement (also referred to as “Agreement”), is entered into between the business indicated on the Merchant Application and Agreement (“Merchant” or “you”), Cynergy Data (“CD” or “Processor”), and BMO Harris Bank, N.A. (“Bank”). The Processor and Bank may be collectively identified as “we” or “us” within the body of this Agreement.
