This Data Privacy Agreement ("DPA") is by and between the Jamestown City School District (the “EA” or “District”), an Educational Agency, and Jamestown Community College (“Contractor” or “JCC”), collectively, the “Parties.” JCC, as the recipient of a federally-funded and New York State- administered Gaining Early Awareness and Readiness for Undergraduate Programs (“NY GEARUP”) Grant, and JPS, as a sub-recipient of such grant, have entered into a partnership (the “Partnership”) in order for JCC to provide project services and activities (“Project Services”) to JPS as outlined in JCC’s grant proposal (the “Agreement” or “Proposal”). The Agreement and related documents executed inconnection therewith is attached hereto as Exhibit A. The Parties enter into this DPA to satisfy the requirements of New York State Education Law Section 2-d and its implementing regulations at 8 NYCRR Part 121.
