WHEREAS, the Florida Department of Environmental Protection, "FDEP", an agency of the State of Florida, has established certain regulations applicable to the Grantor, requiring that an owner or operator of a hazardous waste management facility or group of facilities must demonstrate financial responsibility for bodily injury and property damage to third parties caused by sudden and/or nonsudden accidental occurrences arising from operations of the facility or group of facilities.
