This Provisional Settlement Agreement and Release (“Agreement”) is entered into as of March 21, 2016 (the “Effective Date”), by and among the New York Attorney General (the “Attorney General”) and FanDuel, Inc. (“FanDuel”). The Attorney General and FanDuel are each referred to herein as a “Party” and the Attorney General and FanDuel collectively as the “Parties.”
